Terms of Service

1. Agreement to Terms

By accessing or using Brush (“Service”), operated by Brush Ltd, a company incorporated under the laws of England & Wales, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service.

These Terms are governed by the laws of England & Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.

2. Eligibility

You must be at least 13 years old to use Brush. Users in the European Economic Area must be at least 16 years old unless their member state has set a lower age floor (minimum 13). By creating an account you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at security@troth.shop if you suspect unauthorised access.

4. Permitted Use

You may use Brush solely for lawful purposes consistent with these Terms. You retain ownership of content you upload, subject to the licence in Section 5.

5. Content Licence

You grant Brush a limited, non-exclusive, royalty-free licence to process, store, and transmit your content solely to provide the Service. We do not train AI models on your content without explicit opt-in consent.

6. Prohibited Uses

The following are strictly prohibited on Brush:

  • CSAM. Uploading, creating, distributing, or soliciting child sexual abuse material (CSAM) or any content that sexually exploits minors. Violations are reported immediately to NCMEC and relevant law enforcement.
  • Non-consensual intimate imagery. Creating, distributing, or soliciting deepfake intimate imagery or any non-consensual intimate images of real persons.
  • Identity fraud & impersonation. Using Brush to impersonate any person or entity, fabricate credentials, forge documents, or commit identity theft.
  • Fraud & deception. Creating or distributing manipulated media for the purpose of deceiving others, including political disinformation, insurance fraud, or financial fraud.
  • Harassment & abuse. Targeting, stalking, threatening, or harassing individuals using outputs from Brush.
  • Unlicensed commercial use of protected works. Uploading third-party images, trademarks, or artwork you do not have the rights to and using outputs commercially without authorisation.
  • Scraping & bulk data extraction. Automated scraping of Brush content, user data, or outputs without written permission.
  • API resale. Reselling or sublicensing access to the Brush API or outputs to third parties without a Developer tier agreement and written consent.
  • Circumventing safety measures. Attempting to bypass content moderation, rate limits, or other safety controls.
  • Illegal weapons & harmful substances. Using Brush to create content related to illegal weapons manufacture, trafficking, or harmful controlled substances.

7. EU AI Act — High-Risk AI Systems (Annex III Mirror)

Brush operates AI systems that may fall within the scope of EU Regulation 2024/1689 (the “EU AI Act”). Where our tools are used in contexts listed in Annex III of the EU AI Act (including biometric identification, employment screening, or access to essential services), the following apply:

  • Users must not use Brush for real-time remote biometric identification in publicly accessible spaces, except where permitted by applicable law.
  • Users must not use Brush AI outputs as the sole or primary basis for decisions producing legal or similarly significant effects on natural persons.
  • Brush maintains logs of AI system outputs for a minimum of 6 months to support post-market monitoring.
  • Users who deploy Brush outputs in high-risk AI system contexts must conduct their own conformity assessment and maintain appropriate documentation under the EU AI Act.

8. GDPR & Data Protection

Brush is a data controller under the UK GDPR and EU GDPR. Our Privacy Policy (below) and Data Processing Agreement (for B2B customers) describe how we collect, process, and retain personal data. By using the Service you acknowledge our Privacy Policy.

9. Payments & Refunds

Subscriptions are billed monthly or annually via Stripe. A 7-day money-back guarantee applies to your first charge. After 7 days from the initial charge, payments are non-refundable except where required by law. See our Refund Policy.

10. Termination

We may suspend or terminate your account immediately if you breach these Terms, particularly Section 6 (Prohibited Uses). Accounts terminated for prohibited use are not eligible for refunds. You may delete your account at any time via account settings.

11. Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Brush's aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amounts paid by you in the 12 months preceding the claim, or £100, whichever is greater.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email with at least 14 days' notice. Continued use after the effective date constitutes acceptance.
